About These Terms And Conditions
In these Terms and Conditions "we" and "us" mean Falcon Shelving ( a trading name of Soo-Mart Pty Ltd) ABN 86 124 835 785 of 5/183 McCredie Road, Smithfield NSW 2164 Australia, and "you" means you the customer. Our online web site is www.falconshelving.com.au from here on known as “the website”.
These Terms and Conditions together with your Order constitute the entire Contract between us and you for the supply of Products. No other Terms and Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.
Australian Sales Only
We only sell and ship Products within Australia. We will not make deliveries outside of Australia.
Legal Capacity To Transact
If you are under the age eighteen (18) years you can not place orders with Falcon Shelving.
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
Should Falcon Shelving suffer any damage or other losses as a result of a transaction entered into by a minor, Falcon Shelving reserves the right to seek compensation for such losses from the parents or guardians of the minor who caused any order(s) to be placed with Falcon Shelving.
Payment Methods And Processing
Falcon Shelving currently accepts Visa, MasterCard and Direct Bank Transfer (DBT) only.
Payment processing will not begin until we receive all the information we need.
Orders placed on a weekend or a Public holiday will not begin payment processing until the next business day.
Business days are Monday through Friday, excluding NSW Public holidays.
We process credit card and payments after you click the "Submit My Order" button.
Where you pay by Direct Bank Transfer you must pay the price payable in Australian dollars as indicated on your Order Confirmation within 7 days from the date that you receive your Order Confirmation.
If a DBT payment is not received within 7 days from the date that you receive your Order Confirmation, Falcon Shelving reserves the right to cancel the transaction.
For credit card and DBT payments we will email a tax invoice to you after your payment to all costs including purchase cost, freight, duty, GST etc. has been confirmed.
- We are unable to accept credit cards issued by banks outside of Australia.
- You may be required to provide further identification for additional security reference checks.
All Falcon Shelving products throughout the website are inclusive of GST unless otherwise stated.
Falcon Shelving always seeks to list Products with the most competitive prices. The prices on checkout page is consisted of two components. Product price and freight. If the quantity of your order is 10 units of less and delivery address is in Sydney/Melbourne metro area, the freight calculator will work out the freight automatically. Otherwise you will be reminded to contact us for the freight quotation.
Falcon Shelving reserves the right to change prices for Products displayed at www.falconshelving.com.au at any time.
Supply Of Your Products
Subject to these Terms and Conditions, we will supply to you the Products indicated on your Order Confirmation.
When your Order items have been dispatched, we will email/sms you to confirm shipment of each item including a tracking number for each item.
Delivery Of Your Products
All purchased items will be dispatched/picked up from our Smithfield(NSW2164) or Rowville(VIC3178) warehouses depending on your location and stock held there. Delivery/pick time frame is listed as below.
Timeframe for pickup:
- Smithfield warehouse(NSW2164)
Pay on the spot is available. 9:30am to 5:30pm Monday to Friday(excluding public holidays)
- Rowville warehouse(VIC3178)
Pay on the spot is not available. Payment needs to be cleared before 12pm on the day for same day pickup
Timeframe for delivery:
- Sydney/Melbourne metro area delivery
Same day delivery can only be arranged if payment is cleared before 10:30am on the day. Otherwise delivery will be arranged on the following business day or the day nominated by you.
- Delivery to Sydney/Melbourne non metro areas and other cities
You can either use Falcon Shelving's contracted carrier or your own carrier. When you choose to use your own carrier, 2 working day notice needs to be given and consignment note/shipping labels need to be provided at least 1 working day prior to pickup.
After payment is cleared, booking needs to be made with carrier at least one working day prior to pickup. Transportation takes 2 - 10 working days after dispatch depending on the destination location and carrier's schedule.
Tracking no and estimated delivery time will be provided in notice email/sms after payment's cleared. You should contact the carrier's customer service number with tracking code provided in the email/SMS at the first instance to be updated for the delivery status.
Unless otherwise agreed by us, we will deliver your Products to the address indicated on your Order Confirmation. Normally signature is required for receiving your order unless authorization is received to leave the items to the location nominated without signature. Please note with your authorization, Falcon Shelving takes no responsibility for loss or damage to the items left on site.
Order fulfillment and return/refund policy
All the orders will be processed within 2 working days on receipt of payment. We will inform you within two business days if goods are not available.
Please note it's in Falcon Shelving's absolute discretion to make refunds, credit or replacements if you have changed your mind about the product, make an incorrect choice, or failed to verify and accurately provide information when placing an Order.
Damage On Arrival Products - "DOA"
If you used your own carrier, you will need to contact your carrier to claim the damage. Falcon Shelving's quality control procedure guarantees that all the products dispatched are free of damage. Pictures of the products after being loaded to carrier's vehicle will be provided on request.
If the products are delivered with Falcon Shelving's contracted carrier, Falcon Shelving will be responsible for the damage. Clear digital pictures of the damages/defects are required to be sent within 1 working day to firstname.lastname@example.org on receiving of your products. Digital pictures will help us assess damage quicker. This also helps with our claims on our transport partner. After damages are confirmed to be caused during transportation, Falcon Shelving will either arrange replacement or refund within 5 working days.
Product Problems After Delivery(FAD)
If you find a defect arises after 3 days of delivery, you will need send clear digital pictures to to email@example.com immediately. Falcon Shelving will assess the issues and contact you for solution within 3 working days. If it's manufacturing defect, . Falcon Shelving will either arrange replacement or refund within 5 working days.
Return Authorisation Number - A Must Have
A Return Authorisation Number (RAN) is required for both replacement Products and refunds.
Where Customer Service has provisionally determined that a Product is DOA or quality issue after delivery, Customer Service will issue you with a RAN. Products can not be returned without a RAN. The Product should be returned to Falcon Shelving within 15 calendar days of the issuance of the RAN. All Products must be packed in the original, unmarked packaging including any accessories, manuals, documentation and registration that shipped with the Product.
Organising the Return of DOA Products
DOA Products must be returned whenever we agree to replace the Product or provide you with a refund.
Our customer Service team will email you with instruction for return. You will need to follow the instruction for return so that we can make arrangements with our courier service for collection of the Product, and will notify you when they will collect the Product from you.
We will not be liable for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise.
Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
Your Data - Use And Protection
All the credit card payment will be processed through 3rd party secure gateway. At this instance we use eWay. No credit card information will be kept at our end. The whole payment process is secured with eWay's Secure Socket Layer (SSL) of 128-bit encryption.
By placing your Order, you agree that we may store, process and use data collected from your Order Form for the purposes of processing your Order. If you so indicate on the appropriate section of your Order Form, by placing your Order you also agree that we may use such data, other than credit card details, in order to provide you with information from time to time on other Falcon Shelving Products that may be of interest to you. If you do not agree to our using such data in order to provide you with information on other Falcon Shelving Products, you should indicate your non-agreement on the appropriate section of your Order Form. You may obtain a copy of the data held by us concerning you on request in writing. We reserve the right to charge an administration fee for processing such request. If any data held by us concerning you is incorrect, we will correct it on your written request.
We welcome your comments regarding this web site. However, any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively, "Comments") sent to Falcon Shelving shall be and remain the exclusive property of Falcon Shelving. Your submission of any such Comments shall constitute an assignment to Falcon Shelving of all rights, titles and interests in all copyrights and other intellectual property rights in the Comments.
Falcon Shelving will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way. For this reason, we ask you not to send us any comments that you do not wish to assign to us, including any confidential information or any original creative materials such as stories, product ideas, computer code or original artwork.
Credit Card Fraud
Whilst Falcon Shelving employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Falcon Shelving will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.
You shall not assign any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of Falcon Shelving. Any unauthorized assignment shall be deemed null and void.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.
Under the Trade Practices Act 1974 ("Act"), where implied conditions and warranties cannot be excluded, any liability in Falcon Shelving for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option Falcon Shelving, to the replacement of the Product(s) or the re-supply of the same Product(s); the payment of the cost of replacing the Product(s) or of acquiring equivalent Product(s).
Neither our failure nor your failure to enforce any Term or Condition constitutes a waiver of such Term or Condition. Such failure shall in no way affect the right to later enforce such Term or Condition.
Falcon Shelving reserves the right to change the Terms and Conditions of sale at any time.
No Falcon Shelving employee or agent has the authority to vary any of the Terms and Conditions governing any sale.
We have done our best to display as accurately as possible the colours of the products shown on this web site. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.
Correction of Errors and Inaccuracies; Limitations on Quantity
Whilst Falcon Shelving makes every reasonable effort to present accurate information on this web site, the information may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order).
Please note that such errors, inaccuracies or omissions may relate to product description, pricing and availability. We also reserve the right to limit quantities (including after you have submitted your order). We apologize for any inconvenience this may cause you. If you are not fully satisfied with your purchase please see our returns policy for details on how to obtain a refund.
Falcon Shelving shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Falcon Shelving, and Falcon Shelving shall be entitled to a reasonable extension of time for the performance of such obligations.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
